BÁLVÁNYOS – TUSVÁNYOS SUMMER UNIVERSITY

AND STUDENT CAMP REGULATIONS

The Regulations apply to the organization and carrying out of the Bálványos – Tusványos Summer University and Student Camp (hereinafter Tusványos / Event) and contain the provisions that each participant of the event must comply with.

Preamble

The defined terms have the meanings established in this section unless otherwise defined within this document:

Ticket: a certificate issued in any form (on paper or in electronic format), certifying the right to a Tusványos Bracelet; Tickets are non-nominal or nominal and have a unique identification number. By purchasing the tickets, the buyers agree to abide by the Camp Regulations, the registration procedures, the rules of entry and participation in the event, in general, any other rules of participation in the event, which are brought to their attention through various means of communication, including mainly directly through the Website. The purchase of tickets/bracelets/invitations from areas other than those authorized by the Camp Organizer is strictly forbidden and will result in the restriction of access to the event in question.

Bracelet: a certificate applied by the Organizer upon validation of a Ticket, which grants rights identical to those included in the Ticket.

Ticket Purchaser: the person who purchases the Ticket for one day or for the entire period of the Event at Tusványos and is therefore entitled to receive the bracelet.

Duration of the Tusványos event: the duration of the Tusványos camp will coincide with the period of time between the beginning and the end of the camp. The beginning of the Tusványos will coincide with the beginning of the validity period of the Tickets authorizing the first entry into the camp perimeter. The end of Tusványos will coincide with the expiration date of the Ticket authorizing the longest stay.

The organizer: a non-governmental organization of Romanian nationality, FEDERAȚIA Consiliului TINERETULUI MAGHIAR DIN ROMÂNIA, based in Cluj Napoca, David Ferenc Str., no. 21., ap. 8., TIC 14752780, registration no. 5/PJ/2002, bank account RO53 OTPV 2000 0108 4868 RO01, opened at OTP Cluj-Napoca.

Authorized or unauthorized participant at Tusványos: all persons who are actively on the premises of the camp at any time of day, the campsite included, entering with a valid ticket, or without a ticket, or with a ticket suspected of being illegally acquired.

Website: the official Tusványos website: www. tusvanyos.ro

Regulations: the document containing the General Terms and Conditions (GTCs) governing the Tusványos event, that is available both on the website (as defined above) and at all entrances of the summer camp. GTCs presents the rights and obligations arising from attending Tusványos and the relations that are established between Tusványos and the Participants in connection with the camp, the latter being bound by them, their implementation helping to ensure the safety and comfort of all. By participating in Tusványos, the Participants accept and agree to the conditions of the Organizer to control compliance with the GTCs and the Privacy Policy. Agreement to the GTCs and the Privacy Policy constitutes the establishment of the contractual relationship between the Authorized Participants and the Organizer.

Third Parties: natural and legal persons other than the Organizer, Visitors or Participants.

Visitor: a natural person having the right to enter and participate in Tusványos.

Merchants: an economic operator or other natural/legal person carrying out independent commercial activities at the Event based on a contractual relationship with the Organizer.

Partners: an economic operator or other natural/legal person that has a contractual relationship with the Organizer.

Tusványos Perimeter: the location where the Event takes place in Romania, the town of Baile Tușnad, Harghita County.

  1. APPLICATION OF THE REGULATIONS

1.1. These Regulations are valid and applicable for an indefinite period of time. Participants agree that the Organizer has the right to unilaterally amend the Regulations without giving prior notice to them. If the Regulations are amended, such amendments shall take effect immediately after their publication on the Tusványos website (www.tusvanyos.ro). The Organizer states that the Regulations may be amended even after the purchase of the ticket, even immediately before the camp starts. The Organizer advises Participants to monitor possible changes to the Regulations on the Tusványos website. The present Regulations are applied with regard to the organization and execution of the event Bálványos – Tusványos Summer University and Student Camp (hereinafter Tusványos / Event) and contain the provisions that each participant in the event undertakes to abide by.

1.2 Tusványos will take place on July 23, 24, 25, 26, 27, 28, 2024, in the town of Băile Tușnad, Harghita County. The dates on which Tusványos will take place may be unilaterally changed by the Organizer, and Tusványos may be cancelled in case of force majeure or unforeseeable circumstances. Official recommendations or the entry into force of legal regulations from public authorities that make it impossible or excessively onerous to hold the camp under the conditions envisaged by the Organizer, are assimilated to force majeure.

1.3 The Organizer intends Tusványos to be a safe place, where all Participants feel welcome and comfortable, where no one is discriminated or harassed. We wish that all Participants, regardless of gender, orientation, culture, religion, ethnicity or disability, can be themselves, feel safe and be treated with respect in Tusványos. To achieve this, we expect all Participants to demonstrate responsible behavior.

  1. CONDITIONS FOR ENTRY AND PARTICIPATION
  • Access and participation in the organized events is only possible by wearing a valid and in no way altered access bracelet issued by the organizers. Entrance to Tusványos is FREE daily until 16.00, after this time the price for a one-day pass is 30 RON/person, whereas a pass for the whole week can be purchased for 120 RON/person. The access bracelet received before 16:00 p.m. is also valid after 16:00 p.m. For children under 12 years of age, accompanied by a parent or legal or conventional guardian, entry is free of charge. The access bracelets provide the right to participate in Tusványos only if the person in question accepts the provisions of the Event Regulations, i.e. if he/she admits that compliance with them will be monitored by the organizers.
  • Participants have the obligation to wear their bracelets, for the duration of their validity, on their wrist or, in exceptional and well justified cases, in another visible place, on condition that the bracelet cannot be removed without being damaged. The organizers may inspect the bracelets at the entrance, at the exit, on the entire perimeter and throughout the duration of Tusványos.
  • Access is possible only through specially designated areas.
  • Persons with disabilities categorized as first and second degree of disability are admitted free of charge, even after 16.00, provided that they present valid supporting documents issued by the competent authorities at the entry points. A simple medical note or parking permit will not be accepted as supporting documents.
  • The one-day access pass is valid from 16.00 on the day of purchase until 6.00 on the following morning.
  • In exchange for a fee – personal tents may be pitched on the perimeter of the camp only in the designated area specifically delimited for this purpose. The price for the installation of a tent for one day is 30 RON/person, and for the whole week it can be purchased for 120 RON/person.
  • Upon entering the Tusványos perimeter, the Participant will be able to consult the Regulations, which will be displayed in a visible place in three languages: Romanian, Hungarian and English. The Regulations are also displayed on the website tusvanyos.ro accessible from any online communication device.
  • Each Participant in Tusványos must carry an identity document for age verification and the ticket in print or digital format.
  1. GENERAL RULES OF BEHAVIOR

3.1. It is forbidden for the Participant to enter the Tusványos perimeter in an advanced state of intoxication or under the influence of psychotropic substances.

3.2. It is forbidden to bring into the Tusványos perimeter the following objects: any kind of psychotropic substances, fireworks or any kind of pyrotechnic items, lasers, weapons, blunt objects, flammable or explosive materials, any kind of objects that may injure other Participants as well as sun and rain umbrellas.

3.3. The Participant has the legal obligation to submit to anybody checks carried out by members of the security team. In case any violations of the Regulations are discovered, the members of the security team will escort the concerned Participant outside the Tusványos perimeter and the competent authorities will be notified immediately in order to take all legal measures to eliminate such risks.

3.6 If during checks carried out at the entrance or within the perimeter of Tusványos, it is discovered that objects in breach of the Regulations have been brought in, they will be confiscated and will not be returned.

3.7 The Participant is hereby informed that any commercial or advertising activity, as well as the promotion of products, services, activities, ideas, cultural or political movements, is forbidden on the premises of Tusványos without the written consent of the Organizer, regardless of the means, whether they are online or offline activities.

3.9 Members of the security team have the right to carry out body searches and searches of bags, backpacks and handbags every day before entering Tusványos, and also within the perimeter of the event organizing area.

3.10. Refusal of a body search shall result in the Participant being banned from entering the Tusványos perimeter.

3.11. Access with compact cameras and video cameras is allowed.

3.12. The Organizer assumes no responsibility for lost/stolen objects within the perimeter of the event. If a lost object is found within the perimeter of Tusványos, it will be handed directly to the INFO point.

3.13. It is forbidden to light open fire inside the Event perimeter.

3.14. Pets may be brought only if the following conditions are cumulatively met: a valid vaccination certificate and proof of anti-rabies vaccination of the animal not older than one year, as well as the wearing of a leash and muzzle.

3.15. Vandalism, theft, aggression of any kind will entail immediate expulsion and the filing of a complaint with the competent authorities.

3.16 Begging is forbidden within the perimeter of the Event.

  1. PERSONS WITH MEDICAL CONDITIONS

4.1. Participants take part in Tusványos on their own responsibility, by purchasing the entry ticket they declare that they are physically and mentally fit.

4.2. Persons with medical conditions or medical history of a higher risk category are advised to register at the nearest medical or first aid point and may participate in the event only accompanied by a companion – if necessary. Persons with mental or physical illnesses, epileptic persons, pregnant women or children for whom crowded areas, loud noises, special sound, visual and audio effects pose a risk, assume full responsibility for any damages they may suffer by participating in the concerts organized within Tusványos.

  1. PHOTO – VIDEO RECORDINGS

5.1 During the entire period of Tusványos, the Organizer, its partners or accredited press have the right to record and photograph on the premises of the event. The Participant acknowledges and agrees that there is a possibility to appear in these materials, with without any material or other claims (including those attached to image rights) on them. The Organizer also has the right to use and publish these materials through various means (Youtube, Instagram, Facebook, Tiktok, etc.) and to use them in advertising campaigns without any material compensation to the Participant. Programmes held in Tusványos and the daily life of the event will be recorded in photos, audio and video materials by the organizers. Any Participant, who appears in these recordings, must give his/her consent before being expressly nominated. In the absence of such a nomination, the participant – appearing on the photographic, audio or video material – cannot make any claim of any kind against the organizers or the person making the recording. The recordings may be used by the organizers of the event for various purposes, including publicity purposes, even if minors appear on these materials.

5.2 The participant has the right to film and/or photograph within the perimeter of Tusványos only for personal purposes and only with non-professional equipment (e.g. mobile phone, tablet, compact camera). In case there are presenters, public figures, artists who prohibit filming and photographing, the Organizer will inform the audience that these will be prohibited during their performance.

5.3 The Organizer is exonerated from any liability in the event of the Participant’s failure to comply with the above-mentioned rules, the Participant being personally liable.

5.4. The Organizer has the right to record, through its own means or through third parties, the entire event (speeches, debates, cultural activities, artistic programs, related activities, etc.) and to make the recorded material public by any means.

  1. PROCESSING OF PERSONAL DATA

6.1 For security reasons, the Tusványos perimeter is monitored by video cameras. The processing of personal data captured by the video surveillance cameras takes place at any time within the perimeter of Tusványos, and the Participant explicitly consents to this processing by purchasing a ticket.

6.2. The Participant, the Organizer and the Third Parties are aware that at the entry points to the Tusványos perimeter there are cameras, which record both audio and video.

6.3 According to EU Regulation 679/2016 (GDPR) the Participant has the right of access, the right to rectification, the right to obtain erasure of data or restriction of processing, the right to data portability, the right to object, the right not to be subject to a decision based solely on automated processing.

6.4 In order to exercise these rights, the Participant may address a written, dated and signed request to the e-mail address of the Organizer which can be found on the www.tusvanyos.ro website.

  1. SECURITY AND SAFETY ISSUES

7.1 During and within the perimeter of Tusványos, Participants are required to obey the directives of the security officers and organizers, to cooperate with them and to follow instructions in case of emergency. In the unfortunate event of an incident involving violence or endangering the physical integrity of other Participants, the security personnel can decide to evacuate the Participants involved from the area where the event is taking place. Participants will be prohibited from entering the Tusványos camp area if they are carrying alcoholic or soft drinks, regardless of their quantity. Water is allowed only in open bottles of maximum half a liter. Entry to the camp area with food is also forbidden for health and public hygiene reasons. Only drinks and food purchased on the premises may be consumed in the camp area.

7.2 For security reasons, the Organizer reserves the right: to interrupt or stop the event; to prevent the Participant from leaving the Tusványos perimeter until further notice; to require the Participant to leave the Tusványos perimeter; to deny the Participant access to the Tusványos perimeter, even if the Participant is in possession of a valid entry ticket.

7.3 The Organizer has the right to check the Participant periodically, by means of a random check or following a suspicion reported by the Participant or the security and protection team, and to confiscate any prohibited object that is detected on the Participant.

7.4 The Organizer announces that any Participant in Tusványos must submit to control both at the entrance and inside, in special cases or at the request of the security and protection team / gendarmerie.

7.5 In case the Organizer considers that a Participant endangers the safety of other Participants or creates a situation of discomfort for them or behaves in a manner that disrupts the proper course of the event, the Organizer reserves the right to escort that Participant outside the perimeter of the camp and not to allow him/her back inside the Tusványos perimeter.

7.6 More particularly, for the purposes of the smooth running of Tusványos, the Participant has the following obligations:

(a) to immediately notify the security team and/or the organizers of any situation that they have reasonable grounds to consider a danger to the safety and health of the Participants;

  1. b) report to the security team and/or the organizers any incidents suffered by themselves;
  2. c) to cooperate with the security team and/or organizers, representatives of the competent authorities, in order to ensure that Tusványos runs smoothly without risks to the safety and health;
  3. d) to comply with the provisions of the safety and health legislation and their implementing measures;
  4. e) the Participant who spots a fire has the obligation to notify by any means the security team and/or the organizers in order to contain and extinguish the fire;
  5. f) to comply with the laws in force regarding smoking in enclosed spaces (smoking in enclosed spaces in the Tusványos area is strictly forbidden).
  1. MERCHANDISE/COPYRIGHT

8.1 The Organizer holds all intellectual property rights on trade names, abbreviations, e-mail addresses, domain names or URLs, signs used in correspondence, database, graphic elements, e-mail, business cards and other materials, signs, logos, trademarks as well as on materials, texts and all information, regardless of whether they are registered or not, on Tusványos website or other online channels/platforms in connection with the event. These may not be used, transferred, assigned, modified or distributed without the express, written consent of the Organizer. All of these are subject to intellectual property laws.

8.2. The Organizer holds the intellectual property rights to all works made by its collaborators and/or employees within Tusványos, such as photographs, videos, texts, etc.

8.3. The Participant may not use, copy, distribute, publish or incorporate into other documents or materials such markings/information as the aforementioned in any form for the purpose of obtaining income without the prior express written permission of the Organizer.

  1. LIMITATION OF THE ORGANIZER’S LIABILITY AND FORCE MAJEURE

9.1 Within Tusványos, the Organizer may unilaterally make changes to the program, depending on various situations that may arise during the course of the event. The Participant has no right to claim any compensation in case of such changes, nor the right to obtain a refund of the ticket price.

9.2 The Organizer is under no obligation to cancel Tusványos in case of unfavorable weather, however, if the authorities request the suspension or shutdown of the event by the Organizer due to unforeseeable circumstances or force majeure, Tusványos or part of it will be cancelled/suspended and the Organizer cannot be held liable for its shutdown/suspension.

9.3 The Participants expressly confirm by purchasing the entry ticket that they will not hold the Organizer liable and will not raise any claim against the Organizer for any accidents and/or any damages suffered by them on the premises of Tusványos caused by the acts, deeds or omissions of other natural or legal persons (such as service, food, beverage or equipment providers) and which are not caused by the direct and unequivocal fault of the Organizer.

9.4 Participants expressly confirm with the purchase of the entry ticket that they cannot raise any claim against the Organizer in connection with the products and services provided or in connection with the contract for those products and services. The Organizer also declares that it is not liable in any way whatsoever in connection with the products and services provided by contractual partners. Participants may use the services and products provided by the contractual partners exclusively at their own risk. The Organizer assumes no liability for damages arising out of or suffered in connection with the purchase or use of services and products provided by the contractual partners.

9.5 Participants and unauthorized Participants are fully liable under both civil and criminal law for any damage they have caused to the Organizer, its contractual partners or other Participants.

9.6. The Organizer is not liable for the unlawful acts or omissions of any Participant, Unauthorized Participant or wildlife (e.g. bear). If a Participant or Unauthorized Participant causes damage of any kind to another Participant or Unauthorized Participant, the latter must take all appropriate actions against the person at fault to remedy the damage and not against the Organizer.

9.7 The Organizer shall not be liable for any damage that may occur outside the Tusványos perimeter or on the way to or from the Tusványos area. The Organizer may be held liable, notwithstanding the above exclusions in this section, exclusively only for damage occurring within the perimeter of Tusványos and only if the conditions set out in these Regulations for the liability of the Organizer are met.

9.8. The Organizer has the right to terminate with immediate effect the legal relationship with the Participant (having ticket or bracelet) who has violated any provision of these Regulations in connection with Tusványos. In such a case, the Organizer may invalidate the Participant’s ticket or remove his/her bracelet, and the Participant will be compelled to leave Tusványos. The Organizer also reserves the right to refuse the Participant to purchase a new ticket for the entire duration of Tusványos or, in the event that he obtains a ticket to Tusványos, to deny him access to the Tusványos premises, without granting him any right to compensation.

9.9 The organizer, without any prior notice, may delete, modify or add any information on the website, suspend any activity on the website, and in case of references to other websites of Tusványos does not guarantee and/or confirm in any way the type of information that can be found on these websites.

9.10. The value of the purchased tickets will not be refunded in the event of cancellation of Tusványos by the Organizer due to force majeure or unforeseeable circumstances. Force majeure or unforeseeable circumstances shall mean any external and unforeseeable event such as, but not limited to: storms, threats or risk of terrorist attack, acts of public authorities, whether legitimate or not, epidemics, pandemics, accident, explosions, fires, floods, torrential rain, earthquake, social unrest, major short circuit, high risk of damage to health or any other cases that cannot be foreseen or averted by due diligence and prudence of the Organizer.

  1. CAR TRAFFIC

During Tusványos event car traffic will be restricted, access by car to the perimeter of the camp is only allowed with the Organizer’s consent.

  1. DISPUTES

In case of disputes arising between the Organizer, Participants, Merchants, Partners, Visitor or Third Parties that cannot be settled amicably, the competent courts are those of Cluj-Napoca.

  1. SPECIAL CLAUSES

Persons, including the Event Participants, who wish to attend the speeches, presentations and events, which take place on Saturday, between 06.00 and 15.00 in Tusványos are required to register on the platform www.tusvanyos.ro.

The registration of persons is confirmed by a QR code, communicated by e-mail on Friday of the Event to each person who has been accepted to participate and this QR code must be presented at the entry and bracelet pick-up points. The person who does not present the QR code is not entitled to the bracelet and has no right to access the Tusványos perimeter.

The access of unregistered persons or persons without a valid QR code is forbidden on Saturday of the Event between 06.00 and 15.00 on the Tusványos perimeter, and access may be restricted by the Organizers or any other person authorized by the Organizers.
